Saw mill owner sues Dodge Caravan owner for negligence

WAYNE — A saw mill owner is suing Tri River Transit Authority Inc., a Dodge Caravan owner, citing alleged negligence.

Tolsia Lumber Co. filed a complaint in Wayne Circuit Court against Tri River Transit Authority Inc., alleging that defendant's employee breached his duty to exercise due care while operating defendant's vehicle.

The plaintiff alleges that on Aug. 22, 2016, defendant's employee, Herbert Lee Hoosier (now deceased), negligently caused defendant's Dodge Caravan to collide with plaintiff's saw mill in Wayne County. Plaintiff sustained personal, property and compensatory damages in excess of the jurisdictional limits of the court. 

The plaintiff holds Tri River Transit Authority Inc. responsible because defendant's employee failed to keep proper lookout and failed to maintain proper control of defendant's vehicle.

The plaintiff requests a trial by jury and seeks all damages, with interest and such other appropriate relief. He is represented by Jeffrey S. Simpson of Simpkins Law in Williamson.
