Daughter accuses nursing home facility of causing father's wrongful death

CHARLESTON — A daughter is suing a Kanawha County nursing home facility, alleging wrongful death.

Teresa Wofford of Maiden, North Carolina, as executor of the estate of Larry D. Cottrell, filed a complaint in Kanawha Circuit Court against 1 Sutphin Drive Operations LLC, doing business as Marmet Center, and Genesis Healthcare LLC, alleging the nursing home violated Cottrell's rights as a resident.

According to the complaint, beginning Aug. 3, 2017, Cottrell was a resident of Marmet Center. As a result of the defendants' negligence, the suit says, he suffered pressure skin injuries, dehydration, urinary tract infection, mental anguish and pain and suffering. All allegedly contributed to his death Aug. 27, 2017. 

The plaintiff alleges the defendants failed to provide an environment free of accident hazards, failed to provide adequate supervision and assistive device and failed to provide appropriate health care and protective support services.

Wofford seeks trial by jury, all damages allowed by law, attorney fees, court costs and all other fit relief. She is represented by attorneys Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart Bell PLLC in Charleston.
