Kanawha Co. man accuses Jaguar dealership of violating Lemon Law

CHARLESTON — A Kanawha County man is suing a Jaguar dealership, alleging breach of warranties.

James Ball filed a complaint in Kanawha Circuit Court against Jaguar Land Rover North America LLC, alleging violation of the Magnuson-Moss Warranty Act and the West Virginia Consumer Credit and Protection Act.

According to the complaint, on May 6, 2017, Ball purchased a 2017 Land Rover Range Rover UT from Jaguar Land Rover North America in Kanawha County. Shortly after, the suit says, Ball experienced repeated nonconformities with the Range Rover that substantially impaired its use, value and safety. 

Ball says he has suffered monetary loss, emotional and mental distress, inconvenience and loss of use of the vehicle. The plaintiff alleges Jaguar Land Rover North America failed to make repairs in a good and workmanlike manner so as to bring the vehicle into conformity with its warranties and failed and refused to provide a comparable replacement or to reimburse Ball's purchase price.

Ball seeks trial by jury, cancellation and revocation of acceptance, all damages, interest, litigation expenses and all other appropriate relief. He is represented by attorneys Kristina Thomas Whiteaker and David L. Grubb of The Grubb Law Group in Charleston.
