WINFIELD — A student is suing the county board of education, alleging negligence caused severe injuries to his feet and ankles.
Jackson Crumley filed a complaint in Putnam Circuit Court against the Putnam County Board of Education and John Does, alleging failure to provide a safe and secure school environment.
According to the complaint, on Sept. 17, 2009, Jackson Crumley was sitting in the bleachers in the gymnasium of the defendant's Poca Middle School when the school decided to perform maintenance on the bleachers while youngsters were in the gymnasium.
Crumley says despite moving to a different set of bleachers, a button was pushed by a school board employee, causing the bleachers in the area where Crumley was sitting to begin crushing his ankles and feet. As a result, the suit says, Crumley has started using a wheelchair again after being able to walk as he suffers from Severs disease.
The plaintiff alleges the Putnam County Board of Education and John Does failed to thoroughly and effectively screen, hire and supervise individuals doing maintenance works and failed to recognize the danger of performing maintenance on school bleachers while children were present at the school.
Crumley seeks trial by jury, judgment to compensate for all damages, harms, losses, and injuries, court costs, expenses and fees incurred, plus pre- and post-judgment interest and all other proper relief. He is represented by attorney Kevin P. Davis in Charleston.
