Family member accuses Huntington nursing home of negligence

HUNTINGTON — A family representative is suing a Huntington nursing home facility, alleging negligence.

Lawrence W. Floyd Jr., as power of attorney for Roberta L. Floyd,  filed a complaint in U.S. District Court for the Southern District of West Virginia against Fairhaven OpCo LLC, doing business as Madison Park Healthcare, alleging the nursing home failed to provide the professional standards of care and treatment.

According to the complaint, on Oct. 16, 2015, Roberta L. Floyd, was admitted to the defendant's nursing home care facility at 700 Madison Ave. in Huntington, to receive quality health care. However, the suit says, the Floyd suffered a fall resulting in a proximal femur fracture, a severe urinary tract infection, and she suffered from mental anguish, pain and suffering and incurred medical expense.

The suit says the defendant was negligent in failing to provide a resident with adequate health care, appropriate treatment and supervision, and protective services. 

The plaintiff alleges Madison Park Healthcare failed to fully inform the resident's family members of her health status, failed to provide a sufficient number of staff to provide nursing care, and failed to provide adequate supervision and monitoring of Roberta Floyd to prevent falls.

Lawrence Floyd seeks trial by jury, all damages, attorney fees, punitive damages and all further just relief. He is represented by attorneys Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart/Bell PLLC in Charleston. 

The defendant filed notice to remove action from Cabell Circuit Court to U.S. District Court for the Southern District of West Virginia.
