Former employee accuses mining operators of retaliation

LOGAN — A Kanawha County man is suing coal mining operators, alleging disability discrimination, retaliation and wrongful termination.

Jacob L. Chapman III filed a complaint in Logan Circuit Court against Mingo Logan Coal LLC and Mark Kimler, alleging violation of the West Virginia Human Rights Act.

According to the complaint, on June 7, Chapman was involuntarily terminated from his employment, leading to lost wages and benefits, emotional distress, mental anguish and embarrassment. 

The plaintiff alleges the defendants discriminated against him because of his disability and retaliated against him by terminating him for making a complaint to the Mine Safety Health Administration regarding the operation of one or more belt lines at the mine.

Chapman seeks trial by jury, all damages, litigation costs, court fees and expenses and all other lawful and appropriate relief. He is represented by attorney Phillip Estep of Phillip Estep Law Group PLLC in Charleston.
