State alleges medical service failed to have valid workers' compensation insurance

CHARLESTON — A state government agency is suing state employers, alleging breach of duty and default in payments.

The state of West Virginia, ex rel West Virginia Offices of the Insurance Commission, filed a complaint in Kanawha Circuit Court against WA Medical Services Inc. and James H. Williams II, alleging failure to have valid workers' compensation insurance.

According to the complaint, as a result of the defendants' conduct, the state, other employers and claimants served by plaintiff as well as taxpayers will continue to suffer irreparable harm. The plaintiffs allege WA Medical Services and Williams failed to make certain payments to the West Virginia Offices of the Insurance Commission.

The plaintiffs seek trial by jury, an order enjoining the defendants from doing business in West Virginia until they obtain valid workers' compensation coverage for themselves or until they have ceased working with employees in West Virginia. They are represented by attorney David Ansell of the state's Legal Services Division in Charleston.
