Trucking company alleges repair service failed to fix semi-trailer truck

CHARLESTON — An Illinois trucking company is suing a Parkersburg repair business, alleging breach of contract and negligence.

Overnight Express Inc. filed a complaint in Kanawha Circuit Court against Matheny Motor Truck Company alleging the defendant failed to properly diagnose and repair the issues with a hauling trailer.

According to the complaint, Overnight Express' Freightliner Cascadia hauling trailer was being repaired by Matheny Motor Truck from Sept. 14 to Oct. 29, 2016, after a fire started in the engine compartment. 

However, the suit says, after Overnight Express picked up the semi-trailer truck and it was driven approximately 70 miles, the engine of the truck locked up. Furthermore, after being inspected in Shorewood, Illinois, the lawsuit states, it was determined that the semi-trailer truck failed to be properly diagnosed, causing additional repairs of $35,000 to return the vehicle to good working condition. 

The plaintiff alleges Matheny Motor Truck failed to properly diagnose and repair the issues and created the failures of the semi-trailer truck.

Overnight Express seeks trial by jury, all damages and all further just relief. It is represented by attorney J. Andrew Skeens of Hendrickson & Long PLLC in Charleston.
