Injured driver alleges Liberty Mutual failed to cover damages

NEW CUMBERLAND — An injured driver is suing Liberty Mutual, alleging breach of an insurance contract.

Donna Emery of Moundsville filed a complaint in Hancock Circuit Court against Safeco Insurance, a Liberty Mutual company, alleging the insurer failed to objectively and fairly evaluate the plaintiff's claim.

According to the complaint, Emery was insured under the Saveco policy when she was involved in a vehicle crash and injured as a result of the carelessness of under-insured motorist. 

The suit says the tortfeasor's policy limits are insufficient to compensate Emery for her injuries and damages. Emery said she requested Safeco to tender an offer of the total available under-insured motorist limits of $25,000. 

The plaintiff alleges Safeco refused to pay the demanded amount and, instead, offered only $1,000 to resolve her claim.

Emery seeks trial by jury, damages within the jurisdictional limits of the court, costs, attorney fees and all other appropriate relief. She is represented by attorneys Eric Chaffin and Patrick Booth of Chaffin Luhana LLP in Weirton.
