Breast cancer survivor accuses WVU of medical malpractice

MORGANTOWN — A Harrison County breast cancer survivor has filed a medical malpractice lawsuit.

Paula D. Todd filed a complaint in Monongalia Circuit Court against the West Virginia University Board of Governors alleging the defendant negligently deviated from the accepted standards of care regularly practiced by a well-qualified health care provider.

According to the complaint, on June 13, 2016, Todd underwent a left mastoprexy and right breast reduction performed by the the board of governors' employee physician. As a result of radiation treatment and a lumpectomy to her left breast, the suit says, Todd she was left with breast asymmetry and disfigured. 

The plaintiff alleges the West Virginia University Board of Governors failed to properly perform surgical correction of the asymmetry in her breast.

Todd seeks trial by jury, general damages, pre- and post-judgment interest, attorneys fees, court costs and all other general and specific relief. She is represented by attorneys Edmund L. Wagoner and David E. Goddard of Goddard & Wagoner PLLC in Clarksburg.
