State DOH alleges billboard company damaged property

CHARLESTON — The state transportation department is suing a billboard company, alleging breach of contract and negligence.

The West Virginia Department of Transportation, Division of Highways filed a complaint in Kanawha Circuit Court against Tammy Lynn Outdoor LLC, Boston Omaha Corporation and Link Media Omaha LLC, alleging the defendants damaged the plaintiff's property.

According to the complaint, on Sept. 1, 2016, as part of their maintenance of their outdoor advertising locations, the defendants occupied and altered Transportation Department property in Mercer County. The department alleges while occupying and altering state property, the defendants damaged the property, causing the plaintiff to suffer monetary and non-monetary damages. 

The plaintiff alleges the defendants damaged vegetation belonging to the department as well as destroying fencing and a guardrail.

The Department of Transportation, Division of Highways seeks trial by jury, damages, plus interest, court costs, attorney fees, punitive damages and all other reasonable and just relief. It is represented by attorney Stacy A. Jacques of the state's Legal Division in Charleston.
