WARNER LAW OFFICES PLLC: Delayed Diagnosis leads to $1 Million Award

Warner Law Offices PLLC issued the following announcement on Oct. 19.

A former inmate of a jail in another state claimed that he suffered spinal cord injury injuries following a fall in 2016. He asserted that he went days incarcerated without being treated, which caused him to suffer permanent damage to his nerves. He later filed a lawsuit against the correctional facility where the incident reportedly occurred, which recently resulted in a settlement of $1 million. Anybody in West Virginia who likewise suffers harm due to a doctor's delayed diagnosis has the right to seek justice through the civil court system.

Reportedly, the claim was based on the fact that the former inmate fell one day and requested to be sent to a hospital, as he displayed signs of a spinal cord injury right away. However, based on court documents, he was not transported to a medical center for 10 days. In fact, the man claimed that he was mocked, placed in a wheel chair and taken to a jail cell alone.

During this time, his injuries got worse. Reportedly, he even fell another time. Although the jail staff gave the man a walker, his lower body ended up becoming numb. The man later underwent surgery, but by that time, he had already experienced permanent damage to his nerves. Today, he struggles with balance and suffers from spasms.

Sometimes a delayed diagnosis can end up causing a patient serious damage in West Virginia, and unfortunately, sometimes this damage cannot be undone. However, in this situation, the individual had the right to file a medical malpractice lawsuit, seeking damages due to the failure of the jail's health care staff to recognize and act upon the seriousness of the man's injury. A successfully fought lawsuit under similar circumstances in West Virginia may lead to a monetary award to help with covering medical expenses and documented monetary damages.
