CHARLESTON — A Kanawha County woman is suing a Cross Lanes convenience store, alleging negligence caused her to fall and suffer injuries.
Kimberly B. Persinger filed a complaint in Kanawha Circuit Court against Speedway LLC, alleging failure to provide a safe environment for its business invitees.
According to the complaint, on Sept. 21, 2016, as Persinger was exiting her motor vehicle at the defendant's premises, 5296 Big Tyler Road, Cross Lanes, she was caused to slip and fall to the ground.
The suit says Persinger fell because of the defendant's negligence in the maintenance and inspection of the parking area and sidewalks within the premises of its convenience store. As a result of the incident, Persinger says she suffered great pain and anguish, hindered from her usual activities and incurred medical expenses.
The plaintiff alleges Speedway failed to provide slip guards or slip-resistant surfaces, caused unnatural accumulation of oil and gas that made the parking area and sidewalk unsafe for passage and failed to warn invitees of the dangerous condition of its property.
Persinger seeks trial by jury, damages, costs of action, attorney fees, and all further fit and proper relief. She is represented by attorney Travis E. Ellison III of Law Office of John R. Mitchell Jr. LC in Charleston.
