Passenger alleges motorist's negligence led to crash

CHARLESTON — A Kanawha County man is suing a driver and others, alleging negligence led to a vehicle crash that injured the plaintiff.

Blaine Mullins filed a complaint Sept. 5 in Kanawha Circuit Court against Karen Smith Mullins, McKinney Drilling Company LLC, Triton Construction Inc., the West Virginia Department of Transportation, et al., alleging Smith Mullins carelessly operated her motor vehicle and caused it to strike a portable traffic signal that was negligently placed by the department.

According to the complaint,on Sept. 5, 2016, Mullins was a passenger in a car driven by Smith Mullins on state Route 119 in Elkview, about a half-mile from the Herbert Hoover School when the car was involved in a crash with a portable traffic signal. The suit says Mullins suffered severe injuries resulting in physical and emotional pain, medical expenses and other consequential damages. 

The plaintiff alleges Triton and McKinney negligently allowed a portable traffic signal to be placed and remain in oncoming traffic, posing a hazard to those traveling Route 119, while the Department of Transportation failed to remove of correct the hazard.

Mullins seeks trial by jury, judgment against the defendants, jointly and severally, in excess of the jurisdictional limits of the court, interest and court costs. He is represented by attorney Timothy A. Bradford of Bradford Law Offices PLLC in Charleston.
