West Virginia Department of Transportation alleges Charleston business owes $250,000

CHARLESTON — The state transportation department is suing a Charleston business, alleging breach of an agreement in failing to pay $250,000.

The West Virginia Department of Transportation, Division of Highways filed a complaint in Kanawha Circuit Court against Hogpen Resources LLC and John H. Wellford III, alleging failure to perform their contractual obligations.

According to the complaint, on Aug. 22, 2012, defendants agreed to compensate the department for the modification on Witchter Creek Road for the benefit of their business in the amount of $250,000. The plaintiff says it has incurred financial damages because the defendants have failed to pay the amount specified in the contract.

The West Virginia Department of Transportation, Division of Highways seeks trial by jury, damages to be determined by jury, plus interest, court costs, attorney fees and all other just relief. It is represented by department Legal Division attorney Stacy Jacques in Charleston.
