HUNTINGTON — A Cabell County man is suing a contractor, alleging breach of an oral contract.
Eugene Morrison filed a complaint in Cabell Circuit Court against Anthony Lee McQuaid and Anthony Lee McQuaid Contracting LLC,alleging that they failed to act in good faith and fair dealing.
According to the complaint, on Nov. 27, 2017, the defendants borrowed $55,000 from Morrison with a promise to repay the same for $66,700 in a check. On May 5 and 29, 2018, the suit alleges, the checks written by defendants were returned due to insufficient funds. Morrison says he has suffered monetary losses and great physical and mental anguish.
The plaintiff alleges the defendants failed to repay the loan in a timely manner and refused to repay the agreed upon monetary amount.
Morrison seeks trial by jury, damages to be determined by jury, with interest and coudrt costs. He is represented by attorneys Dwight J. Staples and Gail Henderson-Staples of Henderson, Henderson & Staples LC in Huntington.
