HUNTINGTON — An Ohio motorist is suing another driver, alleging negligence caused a crash.
Jeffrey O. Lewis of Ironton filed a complaint in Cabell Circuit Court against Kimberly Ann Tackett, alleging failure to operate her vehicle in a careful and prudent manner.
According to the complaint, on Sept. 13, 2016, Lewis was operating a motor vehicle and was stopped at the intersection of Sixth Avenue and Eighth Street in Huntington. The suit says Tackett caused her vehicle to collide with Lewis' car, causing the plaintiff to be seriously and severely injured in or about his head, neck, shoulders, back, body and limbs.
The lawsuit alleges Tackett's insurance carrier tendered its liability policy limits of $25,000 but the plaintiff is an under-insured beneficiary of his own policy with Motorist Mutual.
The plaintiff alleges Tackett negligently drove her vehicle and caused it to collide with Lewis' vehicle and Motorist Mutual waived its subrogation rights against Tackett.
Lewis seeks trial by jury, judgment against Tackett and/or Motorist Mutual in an amount exceeding the jurisdictional limits of the court, with interest and court costs. He is represented by attorneys Matthew R. Oliver and Jason A. Leasure of Vital & Vital LC in Huntington.
