Account executive accuses insurance company of wrongful termination

CHARLESTON — A Kanawha County man is suing an insurance agency, alleging age discrimination, breach of employment contract, and wrongful termination.

Randolph H. Neville filed a complaint in Kanawha Circuit Court against Mountain State Insurance Agency Inc., Ross E. Johnson and Taylor Johnson, alleging violation of the West Virginia Human Rights Act. 

According to the complaint, Neville began working for Mountain State in July 2007 as a senior account executive. The suit says on July 27, 2018, the defendants unlawfully terminated his employment as retaliation for his claims of discrimination and retaining counsel for representation. 

The suit says Neville has suffered compensatory damages, including loss of benefits, past and future loss of wages, emotional distress, humiliation, mental anguish and other damages.  

The plaintiff alleges Mountain State Insurance, Ross E. Johnson and Taylor Johnson terminated him in retaliation for his refusal to waive his rights under the West Virginia Human Rights Act, continued to communicate directly to Neville despite being notified that he was represented by counsel and failed to give Neville the required 30 days' written notice as required by the employment contract.

Neville seeks trial by jury, front pay, back pay, interest, loss of benefits, general and punitive damages, attorney fees, court costs, expert witness cots and all just relief. He is represented by attorney John W. Alderman III of Law Offices of John W. Alderman in Charleston.
