State alleges tree service failed to obtain workers' comp insurance

CHARLESTON – The state is seeking to enjoin a company from doing business in West Virginia because allegedly does not have workers' compensation insurance.

State of West Virginia ex rel. West Virginia Offices of the Insurance Commissioner filed a complaint in Kanawha Circuit Court against Acu-Trim Expert Tree Service LLC and Joyce Stalnaker seeking an injunction.

According to the complaint, the plaintiff alleges the defendants have failed to obtain and/or maintain coverage for workers' compensation insurance in violation of state law.

The plaintiff seeks to enjoin the defendants from doing business in the state until they obtain workers' compensation coverage or satisfy that they have ceased working with employees in the state. It is represented by David Ansell in Charleston.

The case has been assigned to Circuit Judge Joanna Tabit.
