Charleston home buyer accuses real estate agents, contractors of fraud

CHARLESTON — A Charleston home buyer is suing real estate agents and contractors, alleging negligent misrepresentation.

Gary Boshier filed a complaint in Kanawha Circuit Court against Paws LLC, Donna Grass Realtors, Great Expectations Realty, doing business as Berkshire Hathaway Great Expectations Realty, and Jake Construction, alleging failure to properly address the issues contained in the building inspector's report.

According to the complaint, on Feb. 17, 2017, Boshier closed in on property at 2018 Piper Circle, Charleston, for $285,000. The suit says as a result of the defendants' negligent misrepresentations, Boshier is currently living in an unsafe and unfinished home that contains substantial defects and has not been approved by the city of Charleston for occupancy. 

The plaintiff alleges the defendants falsely represented that the property was perfect and that it would last Boshier the rest of his life without any problems and that they failed to remedy the defects and construction flaws.

Boshier seeks trial by jury, all damages, litigation costs, interest and all appropriate relief. He is represented by attorney Phillip Estep of Phillip Estep Law Group PLLC in Charleston.
