Oil, gas well operators accused of unpaid royalty interest

MOUNDSVILLE — Royalty interest owners are suing Chevron and other oil and gas well operators, alleging breach of a lease agreement.

KRP Marcellus I LLC, Rivercrest Royalties II LLC, et al, collectively known as the Kimbell Group, filed a complaint in Marshall Circuit Court against Chevron USA Inc., TH Exploration LLC and Does 1-20, alleging they refused to acknowledge the plaintiffs' overriding royalty interest.

According to the complaint, in 2017, as a result of the defendants' actions, Kimbell Group has been damaged for being unable to determine the exact amount of royalties it should receive from oil and gas leases. The plaintiffs allege Chevron USA., TH Exploration and Does 1-20 have failed to provide a full accounting of all substances extracted and sold and have failed to pay overriding royalty interest owed to the plaintiffs.

Kimbell Group seeks trial by jury, an order requiring the defendants to make a full accounting of all goods extracted and sold and the total amount of proceeds from the sale, plus damages in an amount sufficient to compensate for the plaintiffs' monetary injury.
