Fayette County customer alleges GM distributed unsafe vehicle

CHARLESTON — A Fayette County customer is suing General Motors, alleging breach of express and implied warranties.

Bianca R. Nottingham filed a complaint in Kanawha Circuit Court against General Motors LLC, alleging the car manufacturer negligently distributed a vehicle that was not safe for its intended use.

According to the complaint, on July 9, Nottingham purchased a 2018 Chevrolet Cruze for $27,367.50 from King Coal Chevrolet. On Aug. 5, the suit says, Nottingham's spouse was injured and could have died when the Cruze caught fire. 

Nottingham says she was required to secure other more reliable transportation. The plaintiff alleges General Motors failed to make any offer to resolve the matter of selling a defective, fire-catching vehicle.

Nottingham seeks trial by jury, revocation of acceptance and refund of the purchase price, compensatory and punitive damages, litigation costs, fees and expenses and all other just relief. She is represented by attorney J.C. Powell of Powell & Majestro PLLC in Charleston.
