Woman accuses car repair service of intentional misrepresentation

CHARLESTON — A Charleston motor vehicle owner is suing a Dunbar auto repair service, alleging fraud and conversion.

Marjorie Cook filed a complaint in Kanawha Circuit Court against Auto & Diesel Specialist LLC, Adam Miller and Jerry Weaver, alleging they wrongfully took possession of and retained the plaintiff's vehicle.

According to the complaint, on June 25, 2017, Cook purchased a used Chevrolet Monte Carlo from defendants for $1,000. In spring 2018, the suit says, Cook began to experience faulty brakes that resulted in a minor accident. 

Soon after, Cook says, the defendants took possession of the vehicle for repairs. As a result of defendants' fraudulent actions, the suit alleges, Cook suffered significant worry, stress and loss of use of her vehicle. 

The plaintiff alleges Auto & Diesel Specialist, Miller and Weaver falsely represented that they would repair her vehicle for $300 but later asserted she must pay $1,400 to retrieve it or the defendants would sell or otherwise dispose of the Monte Carlo.

Cook seeks trial by jury, actual and punitive damages, an order requiring the defendants to return her vehicle, attorney fees, costs, interest and all other just and equitable relief. She is represented by attorney Bren J. Pomponio of Mountain State Justice Inc. in Charleston.
