Huntington restaurant owners allegedly owe more than $400,000

HUNTINGTON — An Ohio man is suing restaurant business owners, alleging breach of contract.

Xavier W. Staggs of Lawrence, Ohio, filed a complaint in Cabell Circuit Court against Prime Restaurant Properties LLC, Joseph Evans, Tiffany Evans and Michael Weicker, alleging the defendants have failed to pay more than $417,000. 

According to the complaint, between 2015 and 2017, under the note, promissory and guarantee agreements, the defendants were required to make payments that they defaulted on despite numerous demands amounting to $417,780.50, plus interest. 

The plaintiff alleges the defendants failed to make timely required payments pursuant to the 2015 note, the 2017 note the 2015 security agreement, the loan agreement and the guarantee agreement.

Staggs seeks trial by jury, judgment for unpaid principal of $417,780.50, plus 2 percent interest since September, and any other just and equitable relief. He is represented by attorney Abraham Saad of Saad Dixon Law Offices PLLC in Huntington.
