CHARLESTON — An insurance company is suing an Elkview roofing contractor, alleging breach of an insurance contract and unjust enrichment.
Cincinnati Insurance Companies filed a complaint in Kanawha Circuit Court against Mr. Roofer LLC, alleging that the contractor violated the terms of the insurance policy by failing to pay more than $12,000..
According to the complaint, at the request of the defendant, Cincinnati Insurance issued a general liability policy naming Mr. Roofer as the insured. Subsequent to the termination of the policy, the suit says, the plaintiff conducted an audit and determined that Mr. Roofer was required to pay an earned premium of $12,575.27.
The plaintiff alleges Mr Roofer has failed and refuses to pay all earned premiums in the said amount.
Cincinnati Insurance seeks trial by jury, judgment for $12,575.27, with interest, court costs and all other just relief. It is represented by attorney John R. Keating of Amato Keating and Lessa PC in Bethlehem, Pennsylvania.
