Former employee accuse mining company of unlawful termination

BECKLEY — A former employee is suing a mining company, alleging disability discrimination and violation of workers compensation acts.

Johnathan Baer filed a complaint in Raleigh Circuit Court against Blackhawk Mining LLC, doing business as Blue Creek Mining LLC, alleging violation of the West Virginia Workers' Compensation Act.

According to the complaint, on June 4, Baer, who was working for Blue Creek Mining as an electrician, was injured at work. Subsequently, the suit says, he was terminated July 20. The suit says Baer has suffered the loss of wages and employment benefits and other damages. 

The plaintiff alleges Blue Creek Mining terminated his employment for attempting to receive workers' compensation benefits.

Baer seeks trial by jury and judgment against the defendant justified by the evidence. He is represented by attorney Greg A. Hewitt of Hewitt & Salvatore LLC in Fayetteville.
