Health care group accuses bank of illegal conversion

PRINCETON — A Bluefield health care business is suing a bank, alleging conversion.

West Virginia Healthcare Inc. filed a complaint in Mercer Circuit Court against Tammy Lynn LLC and MCNB Bank and Trust Company, doing business as McDowell County National Bank, alleging they acted in concert to attempt to convert ownership of Mercer County property owned by the plaintiff.

According to the complaint, the plaintiff alleges Feb. 22, 2017, West Virginia Healthcare purchased three parcel of lands in Bluefield previously owned by Leblank Holdings. The suit says as a result of the defendants' wrongful conduct, the plaintiff was impeded from developing and enjoying the property. 

The plaintiff alleges Tammy Lynn LLC and McDowell County National Bank unlawfully executed and recorded a deed of trust securing the plaintiff's property in the amount of $1.2 million on Feb. 28, 2017.

West Virginia Healthcare seeks trial by jury, an order declaring the plaintiff is the lawful owner of the properties that were purchased Feb. 22, 2017, and barring the defendants from asserting any claim to or interest in any of the three properties, plus all other just and proper relief.
