Driver alleges freightliner operators' negligence caused crash

WHEELING — A Texas motorist is suing freightliner operators, alleging negligence caused a crash that injured the plaintiff.

Travis William Wilcox of San Antonio filed a complaint in Ohio Circuit Court against Market Trucking LLC, et al, alleging they negligently permitted Rickie Samuel to drive a freightliner beyond his maximum allowable hours of service, making him fatigued, incompetent and unqualified.

According to the complaint, on Sept. 29, 2016, Wilcox was traveling on Interstate Highway 70 when Samuel fell asleep and lost control of the defendants' freightliner, causing it to cross the grassy median lane and strike multiple vehicles, including the car driven by the plaintiff. Wilcox says he suffered serious injuries, resulting in extreme pain, mental anguish and emotional distress, medical expenses and lost wages. 

The plaintiff alleges Samuel failed to be alert while driving, submitted fraudulent hours of service and failed to keep his vehicle under control.

Wilcox seeks trial by jury, compensatory and punitive damages, with interest, court costs and all other just and proper relief. He is represented by attorney Kevin P. Davis of Charleston.
