Consumer accuses capital management business of unfair collection practices

CLARKSBURG — A Preston County man is suing debt collectors, alleging false and deceptive debt collection practices.

John Knotts filed a complaint in U.S. District Court for the Northern District of West Virginia against Yorba Capital Management LLC and Daniel Portilla, alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, on April 27, Knotts received a call from Yorba Capital demanding payment of $2,341.20 that he allegedly owed Wal-Mart. As a result of the defendants' unlawful actions, Knotts says he has been damaged. 

The plaintiff alleges Yorba Capital Management and Portilla failed to produce any document of the charges and threatened him that nonpayment would result in wage garnishment, a levy on his bank account, a lien on his property and suspension of his licenses.

Knotts seeks trial by jury, actual damages, statutory damages of $1,000 for each violation of the act, attorney fees, costs and all just and proper relief. He is represented by attorney Jeffrey V. Mehalic of Law Office of Jeffrey V. Mehalic in Morgantown.
