Consumer seeks refund from General Motors after Chevy Cruze catches on fire

CHARLESTON – A Fayette County consumer alleges the General Motors manufactured vehicle he purchased earlier this year was a "fire bomb" and is seeking a refund.

Keneith C. Bolen filed a complaint in Kanawha Circuit Court against General Motors LLC alleging breach of express warranty and other counts.

According to the complaint, the plaintiff alleges that on Aug. 5, less than a month after purchasing a 2018 Cruze from King Coal Chevrolet Co., plaintiff was injured when the vehicle caught fire while he was driving it to his place of employment. The suit states King Coal Chevrolet is an authorized independent franchisee of the defendant, and the defendant has refused to replace the vehicle.

The plaintiff holds General Motors LLC responsible because the defendant allegedly advertised the vehicle was reliable and affordable transportation "when it knew or had reason to know that it was unsafe and a fire bomb," the suit states.

The plaintiff seeks revocation of acceptance and refund of the purchase price, punitive damages, attorney's fees, costs and all other appropriate relief. He is represented by James C. Powell of Powell and Majestro PLLC in Charleston.

The case has been assigned to Circuit Judge Carrie Webster.
