Father alleges rehab center caused son to suffer further injuries

LOGAN — A father is suing Logan County medical facilities, alleging medical negligence.

Dalton Foster, by and through his guardian and next friend, Joseph Foster, filed a complaint in Logan Circuit Court against Genesis Eldercare Rehabilitation Services LLC, Genesis Healthcare LLC, Genesis Hospitality Services LLC, et al. alleging medical malpractice in causing Dalton Foster to suffer further injuries.

According to the complaint, between Nov. 18, 2016- June 8, 2017, Dalton Foster received medical care and treatment at the defendants' Logan Center after suffering a drug overdose. 

However, the suit says, Foster's rehabilitation was not complete as his drug overdose has been compromised due to the defendants' negligent care and treatment. 

As a result, Dalton Foster says he has suffered injuries, diminution in the ability to enjoy life and is limited in his ability to perform daily activities. 

The plaintiffs allege the defendants failed to provide the proper therapy for a drug overdose patient.

Dalton Foster and Joseph Foster seek trial by jury, damages, pre-and post-judgment interest, costs, expenses and all other just and proper relief. They are represented by attorney Robert H. Miller, II of The Sutter Law Firm, PLLC in Charleston.
