West Virginia company alleges kitchen/flooring business owes $20,000

WHEELING — A West Virginia company is suing a kitchen/flooring business, alleging breach of contract.

Mohawk Servicing LLC filed a complaint in Ohio Circuit Court against Herr LLC, doing business as Dlesk Kitchens and Flooring, and Kelly Herr, also known as Kelly Dlesk, alleging they owe more than $20,000. 

According to the complaint, Mohawk Servicing has suffered monetary damages for items sold and delivered to defendants in the amount of $20,078.47, to which the defendants have failed to pay and/or fulfill obligation as the guarantor. The plaintiff alleges the defendants have failed to honor obligations under a master agreement and personal guaranty entered into by both parties in 2014.

Mohawk Servicing seeks trial by jury, judgment against defendants of $20,078.47, plus interest, attorney fees, costs of action and all further appropriate relief. They are represented by attorney Ryan S. Marsteller of Bailes, Craig & Yon PLLC in Huntington.
