Former employee accuses Princeton restaurant of wrongful termination

PRINCETON — A Mercer County woman is suing a Princeton Mexican restaurant, alleging battery, hostile work environment, negligence and wrongful termination.

Alyssia L. Diaz filed a complaint in Mercer Circuit Court against David Lovely, Leonardo Lopez and El Toro LLC, doing business as El Toro Mexican Restaurant, alleging violation of the West Virginia Human Rights Act.. 

According to the complaint, on April 16, Diaz suffered embarrassment, humiliation, annoyance, inconvenience, harassment, indignation and distress as a result of being terminated from her employment as a waitress at El Toro in Princeton. She said she was fired for rejecting unwanted sexual advances from Lovely, her direct supervisor, prior to her termination. 

The plaintiff alleges Lovely, Lopez and El Toro Mexican Restaurant failed to reasonably train and supervise its officers, and created an intimidating, hostile and offensive work environment for Diaz, terminated her for rejecting her supervisor's sexual advances, and failed to pay Diaz for her first three days of employment.

Diaz seeks trial by jury, actual, general, statutory and punitive damages, attorney fees, costs of litigation, equitable relief and all further just relief. She is represented by attorneys Brian K.
