Ambulance passenger accuses fire department of negligence in crash

WINFIELD — An ambulance passenger is suing the local fire department, alleging negligence caused a crash that injured the plaintiff.

Betty Lee Herdman filed a complaint in Putnam Circuit Court against Teays Valley Volunteer Fire Department Inc. and Westley Scott Amores, alleging they failed to exercise reasonable care for the safety of their passengers.

According to the complaint, on Jan. 24, 2017, Herdman was being transported on a gurney at the back of the defendants' ambulance when the vehicle struck a telephone pole, went over the hill and struck a tree and a pile of lumber in a field. Herdman says she sustained serious injuries, resulting in tremendous pain and mental anguish, medical expenses, anxiety and other damages. 

The plaintiff alleges Amores negligently fell asleep while driving, thereby losing control of the Teays Valley Volunteer Fire Department ambulance he was operating.

Herdman seeks trial by jury, compensatory and punitive damages, court costs and expenses, attorney fees and all other just and proper relief. She is represented by attorney Joshua R. Martin of The Martin Law Firm in Nitro.
