Daughter alleges nursing home facility's negligence caused mother's injuries

CHARLESTON — A South Charleston woman is suing nursing home facility operators, alleging negligence in the treatment of the plaintiff's mother.

Cindy Wilson, as power of attorney for Joyce Davidson, filed a complaint in Kanawha Circuit Court against St. Albans Operating Company LLC, doing business as Riverside Health and Rehabilitation Center, alleging it violated Davidson's nursing home resident's rights.

According to the complaint, between May 3-27, 2017, Davidson was a resident at the defendants' nursing facility in St. Albans. During that period, the suit says, Davidson suffered multiple falls resulting in an L3 compression fracture and left foot acute fractures of the second and fifth metatarsal bases. 

The plaintiff alleges the defendants failed to provide appropriate nursing care, failed to provide health care services in compliance with state laws and failed to promote enhancement of quality of life.

Wilson seeks trial by jury, all damages allowed by law, attorney fees, court costs as well as all other just awards. She is represented by attorneys Jeff D. Stewart, Andrew L Paternostro and S. Andrew Stonestreet of Stewart Bell PLLC in Charleston.
