CHARLESTON — A customer and her husband are suing Dollar General, alleging negligence caused the wife to suffer a broken hip.
Frances Coleman and Jerry Coleman filed a complaint in Kanawha Circuit Court against Dollar General Corporation, alleging failure to maintain its store premises in a reasonably safe condition.
According to the complaint, on Nov. 22, 2016, Frances Coleman was shopping at a Dollar General retail establishment in the Rand area of Kanawha County. The suit says Coleman stepped on a box of goods on the floor, causing her to fall and fracture her left hip.
The lawsuit states Coleman has suffered great pain of body and mind, lost wages, loss of the ability to enjoy life and medical expenses. Jerry Coleman alleges loss of consortium and the services of his wife.
The plaintiffs allege Dollar General employees negligently left the box of goods on the floor along the aisles of the store, creating a hazard.
The Colemans seek trial by jury, compensatory and punitive damages, with interest, attorney fees, court costs and expenses. They are represented by attorney Larry L. Rowe of Charleston.
