Consumer files suit against General Motors, Triadelphia dealership over alleged truck defects

WHEELING – A consumer alleges a truck he purchased at a Triadelphia dealership has issues with its drive chain and is seeking damages from the manufacturer and the dealership.

Roy Swallie filed a complaint in Ohio Circuit Court against Bob Robinson Chevrolet-Oldsmobile-Cadillac Inc. and General Motors Inc. alleging violation of the West Virginia Consumer Protection Act, breach of contract and other counts.

According to the complaint, the plaintiff alleges that on Dec. 7, 2016, he purchased a new GMC half-ton Denali truck from Bob Robinson Chevrolet-Oldsmobile-Cadillac in Triadelphia for $67,678.31. Soon after taking possession of the truck, the plaintiff alleges he noticed significant vibration because of a problem with the truck's drive chain. He alleges Bob Robinson Chevrolet-Oldsmobile-Cadillac has failed to repair the issue despite multiple attempts.

The plaintiff holds Bob Robinson Chevrolet-Oldsmobile-Cadillac Inc. and General Motors Inc. responsible because Bob Robinson Chevrolet-Oldsmobile-Cadillac allegedly did not provide him with a new truck that properly operated and General Motors allegedly failed to provide the dealership with a defect-free truck.

The plaintiff seeks out-of-pocket damages, attorney's fees, costs and such other just and proper relief. He is represented by Bruce M. Clark of The Bruce Clark Law Firm LLC in Mount Pleasant.
