CHARLESTON — A financing company is suing Capitol Valley Contracting Inc. and Mickey Farmer, debtor, citing alleged breach of contract.
Financial Pacific Leasing Inc. filed a complaint in Kanawha Circuit Court against the defendants alleging that they breached their duty of good faith and fair dealings.
According to the complaint, the plaintiff alleges that Financial Pacific Leasing Inc. has suffered monetary damages of $221,676.67, an accelerated balance due and owing to plaintiff under the Equipment Financing Agreement and Guarantee entered into with the defendants on Aug. 30, 2017, for the purchase of a 2012 Cat 740B, as a result of defendants' breach and default of the agreement.
The plaintiff holds Capitol Valley Contracting Inc. and Mickey Farmer responsible because the defendants allegedly failed to make payments under the terms of the agreement and personal guaranty, and obligated plaintiff to hire and retain a legal counsel to protect its interest.
The plaintiff requests a trial by jury and seeks judgment against defendants in the amount of $221,676.67, plus interest, costs, attorney's fees, and other relief as the court may deem just. They are represented by Joel P. Jones Jr. of Campbell Woods PLLC in Huntington.
