Ona business says water company caused damage to property

HUNTINGTON – An Ona property owner alleges it incurred more than $20,000 in damages because a water line was negligently connected.

John-Ty LLC filed a complaint in Cabell Circuit Court against West Virginia American Water Co. alleging nuisance, trespass and other counts.

According to the complaint, the plaintiff alleges the defendant turned on services to a water meter/line that was disconnected, which discharged water in and under the plaintiff's property. The plaintiff alleges the water caused $27,980 in damages. 

The plaintiff holds West Virginia American Water Co. responsible because the defendant allegedly negligently turned on service to the water meter.

The plaintiff seeks all damages, with interest, costs, attorney's fees and such other just and proper relief. It is represented by Michael S. Bailey of Bailey Legal Services PLLC in Barboursville.

The case has been assigned to Circuit Judge Christopher D. Chiles.
