WHEELING — A licensed insurer and the insured are suing Klear Energy Services LLC, et al, water treatment providers, citing alleged breach of contract and negligence.
Continental Casualty Co. and Ohio Valley Health Services Education filed a complaint in Ohio Circuit Court against the defendants alleging that they breached their duty to properly design and manufacture the water system.
According to the complaint, the plaintiff alleges that on Oct. 23, 2016, a hospital shift engineer discovered that there was no steam pressure in the west building of plaintiff Ohio Valley hospital. It was determined that the boiler severely overheated, and that caused extreme damage to the boiler. Plaintiff Continental made payments for damages totaling $358,000. The plaintiff holds Klear Energy Services LLC, et al responsible because the defendants allegedly failed to provide correct chemicals, mixture and/or composition of chemicals and failed to provide proper warnings of any dangers associated with the system.
The plaintiff requests a trial by jury and seeks judgment against defendant in the amount of $358,000, with interest, costs and such other and further relief that is proper and just. They are represented by Angela P. Mason of Cozen O'Connor in Charlotte, North Carolina.
