MOUNDSVILLE — Real property owners are suing Mike Enyart & Sons Inc., an Ohio contractor, citing alleged negligence.
Philip Smith and Tammy Smith filed a complaint in Marshall Circuit Court against Mike Enyart & Sons Inc. alleging that the Ohio contractor failed to perform work in a good and workmanlike manner.
According to the complaint, the plaintiffs allege that Philip and Tammy Smith's property adjacent to defendant's worksite suffered substantial damage due to ongoing discharge of sewage. Plaintiffs suffered loss of use of the property and costs in repairing and diminution in value of the property. The plaintiffs holds Mike Enyart & Sons Inc. responsible because the defendant allegedly negligently performed work, causing the collapse and interruption of the sanitary sewer line.
The plaintiffs request a trial by jury and seek monetary damages, with interest and costs. They are represented by Anthony I. Werner of John & Werner Law Offices PLLC in Wheeling.
