Mortgagor accuses PHH Mortgage of contract breach

CHARLESTON — A mortgagor is suing PHH Mortgage Corp., a loan servicer, citing alleged breach of contract.

Dara L. Ray filed a complaint in Kanawha Circuit Court against PHH Mortgage Corp. alleging that the loan servicer violated the West Virginia Consumer Credit and Protection Act.

According to the complaint, the plaintiff alleges that on Oct. 25, 2002, she entered into a loan secured by her home for $68,700 with Summit Mortgage that was later assigned to defendant. As a result of defendant's conduct, plaintiff has been damaged and was caused to suffer fear of losing her home. The plaintiff holds PHH Mortgage Corp. responsible because the defendant allegedly failed to provide assistance and referred her home to foreclosure.

The plaintiff requests a trial by jury and seeks actual damages, attorney's fees, costs and all other appropriate relief. She is represented by Bren J. Pomponio of Mountain State Justice Inc. in Charleston.
