Estate administrator accuses mobile home community operators of negligence in heroin death

MORGANTOWN — An estate administrator is suing Gary Allan Richmond and Independence Hill MHC LLC, et al, mobile home community operators, claiming the former provided the decedent with heroin and the latter were negligent by not prevening the sale on their property.

Rick Sovastion, as administrator of the estate of Hannah M. Sovastion, filed a complaint in Monongallia Circuit Court against the defendants alleging that the mobile home community operators breached their duty to prevent the sale of heroin on their property.

According to the complaint, the plaintiff alleges that on Oct. 20, 2016, Hannah Sovastion was at the parking lot in front of the Independence Hill office to meet defendant Richmond to purchase heroin. After injecting herself with the heroin, she was immediately rendered unconscious and died. The plaintiff holds Gary Allan Richmond responsible for allegedly providing the heroin and Independence Hill MHC LLC, et al responsible because defendants mobile home community operators failed to prevent the illegal activities from occurring on their property.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, with interest, attorney's fees, costs and such other and further relief deemed just and proper. He is represented by Jeffrey V. Mehalic of Law Offices of Jeffrey V. Mehalic in Morgantown.
