PRINCETON – A McDowell County couple is seeking a refund of a vehicle they purchased from a Bluefield auto dealer over allegations of defects.
Penny Lester and Edward Lester filed a complaint in Mercer Circuit Court against Cole Chevrolet-Cadillac Inc. and General Motors LLC alleging breach of factory warranty and other counts.
According to the complaint, the plaintiffs allege that on April 28, 2014, purchased a 2014 Cadillac from Cole Chevrolet-Cadillac Inc. that was manufactured by General Motors. They allege shortly after they purchased it, they discovered several defects on the vehicle with the cruise control, headlamps, and other parts and that the vehicle would not go faster than 20 mph. They allege Cole Chevrolet-Cadillac has made repairs but the defects still exist.
The plaintiffs hold Cole Chevrolet-Cadillac Inc. and General Motors LLC responsible because the defendants allegedly General Motors failed to honor the terms of the warranty and Cole Chevrolet-Cadillac has refused to comply with the plaintiffs' demand for a refund.
The plaintiffs request a trial by jury and seek judgment against defendants for actual damages, refund of purchase price, incidental and consequential damages, attorney's fees, costs of suit, equitable relief and further relief as the court deems just. They are represented by Dean Morgan of Lemon Law Group Partners PLC in North Miami Beach, Florida.
The case has been assigned to Circuit Judge William J. Sadler.
