WHEELING — An Ohio couple is suing a Texas driver, alleging his negligence caused a crash that injured the husband.
John Wilhelm and Nancy Wilhelm of Bellaire Ohio, filed a complaint in Ohio Circuit Court against Roberto Hernandez Garcia of Jacksonville, Texas, alleging the defendant failed to exercise due care in operating his vehicle.
According to the complaint, on March 6, 2017, John Wilhelm was involved in an auto collision at the intersection of 26th Street and state Route 2 in Wheeling. The suit says Wilhelm sustained injuries to his head, neck and various parts of the body and incurred medical bills and other damages.
Nancy Wilhelm says she suffered the loss of love, society and comfort of her husband. The plaintiffs allege Garcia failed to maintain proper control of his vehicle, failed to obey a traffic control device and improperly used travel lanes.
The Wilhelms seek trial by jury, judgment to be determined by the jury, with interest, attorney fees, court costs and all other proper relief. They are represented by attorneys Scott S. Blass and Erica A. Cross of Bordas & Bordas PLLC in Wheeling.
