Maintenance foreman accuses Ramaco Resources of wrongful termination

LOGAN — A maintenance foreman is suing Ramaco Resources LLC and Caryn Merton, coal mine operators, citing alleged disability discrimination, retaliation and wrongful termination.

Gary May filed a complaint in Logan Circuit Court against the defendants alleging that they violated the West Virginia Human Rights Act.

According to the complaint, the plaintiff alleges that on Oct. 19, 2018, he was terminated from his employment. He was caused to suffer loss of income and benefits, humiliation, embarrassment and loss of personal dignity. The plaintiff holds Ramaco Resources LLC and Caryn Merton responsible because the defendants allegedly failed to engage in interactive process to determine what accommodation he needed and discriminated and retaliated against him by terminating his employment because of his disability and/or perceived disability.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, attorney's fees, costs, interest and all other relief as the court may deem appropriate. He is represented by Nathan D. Brown of Ferrell & Brown PLLC in Williamson.
