A property owner suing Allstate Insurance, citing breach of contract

NEW CUMBERLAND — A property owner is suing Allstate Insurance Company, insurer, citing alleged breach of contract.

Daniel Strapazzon II filed a complaint in Hancock Circuit Court against the defendant alleging that it breached its duty of good faith and fair dealings.

According to the complaint, the plaintiff alleges that, on Oct. 21, 2017, Daniel Strapazzon II suffered and continues to suffer annoyance, aggravation, inconvenience and financial loss as a result of defendant's breach of the insurance policy by obligating plaintiff to initiate litigation in order to recover benefits he is entitled to under the law, for damages he sustained when third parties crashed their vehicle into his residence located in New Cumberland in Hancock County, West Virginia. Additionally, plaintiff suffered further harm from defendant's refusal to discount its claim of subrogation against the proceeds obtained by plaintiff from third party insurers. 

The plaintiff holds Allstate Insurance Company responsible because the defendants allegedly forced plaintiff to incur attorneys' fees and litigation costs for a coverage he is entitled to and refused to reasonably reduce its subrogation claim.

The plaintiff requests a trial by jury and seeks judgment against defendant for all damages, declaratory relief, attorneys' fees, costs, interests, and further relief as the court deems just.
