CHARLESTON — A risk underwriter is suing Neville Galvanizing Inc., a Pennsylvania corporation, citing alleged breach of contract and unjust enrichment.
Brickstreet Mutual Insurance Company filed a complaint in Kanawha Circuit Court against Neville Galvanizing Inc. alleging breach of contractual obligations.
According to the complaint, the plaintiff alleges that from Dec. 18, 2017, through and including Dec. 12, 2018, it provided defendant with workers' compensation and employer's liability insurance. As of the filing of this complaint, the premium amount of $31,745 remains due and unpaid. The plaintiff holds Neville Galvanizing Inc. responsible because the defendant allegedly failed to pay the premium owed.
The plaintiff requests a trial by jury and seeks judgment against defendant in the amount of $31,745, costs, attorney's fees, interest and such other just and proper relief. It is represented by Arnold J. Janicker and Steven P. Turner of Jenkins and Fenstermaker PLLC in Huntington.
