Former employee sues employer citing disability discrimination

CHARLESTON — A former employee is suing a business and its owner, citing alleged disability discrimination and wrongful termination.

Kira Myers filed a complaint in Kanawha Circuit Court against Valley Wellness Pharmacy LLC and Dipti Patel alleging they violated substantial public policy.

According to the complaint, the plaintiff alleges that on June 22, 2018, she was terminated from her employment. She was caused to suffer lost wages and benefits, damage to dignity, embarrassment, humiliation, annoyance and inconvenience. The plaintiff holds Valley Wellness Pharmacy LLC and Dipti Patel responsible because the defendants allegedly subjected her to adverse employment actions and terminated her due to her disability.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, attorney's fees, costs, interest and such other just and proper relief. She is represented by Philip A. Reale III of Law Office of Philip A. Reale PLLC in Charleston.
