Husband and wife accuse stone patio contractor of breach of contract

CHARLESTON — A husband and wife are suing a stone patio contractor, citing alleged breach of contract and negligence.

Paul White and Raye King filed a complaint in Kanawha Circuit Court against Terry Bailey and L&T Property Solutions LLC alleging they negligently performed work in an unworkmanlike manner.

According to the complaint, the plaintiffs hired and contracted defendants to build walls and stone patio around their existing swimming pool. As a result of defendants' failure to properly construct the project, water incursion under the patio caused the surface to become unsafe and unusable. They had to employ another contractor to repair the damage in an amount in excess of $64,000. The plaintiffs holds Bailey and L&T Property Solutions responsible because the defendants allegedly failed to implement appropriate drainage and support for the patio.

The plaintiffs request a trial by jury and seek compensatory damages and all other relief available under the law. They are represented by Charles M. Love IV of The Love Law Firm PLLC in Charleston.
